Falling down an escalator in a dept store.

Is there any cash value evevn if it was partialy my fault and partialy Macy's fault?

New York is a "comparative negligence" State. That is, a jury is permitted to apportion, or divide, responsibility for an accident. Depending on the facts, even though the accident victim is partially responsible for what happened, she may still collect something. Best, M. E. Zuller

I think you mean... Is it likely that Macy's insurance carrier would settle a slip and fall claim when you are partly at fault. Answer... Probably not. Claims are usually settled pre-suit when the insured is 100 percent at fault.Depending on the severity of your injury I would get a personal injury attorney.
