Legal Question in Personal Injury in New York

I fell outside my apartment and now cannot work. Need advice.

Hi there. I need some advice. I fell last week off my front step outside my apartment and hurt my arm very badly. I had to go to the emergency room twice and now I am in a cast on my left arm from my fingers to my elbow. My wrist is broken and I almost had to have a pin put in near my thumb but the doctor decided not to do that. However, in 4 weeks I will have this cast removed and another smaller one put on and then will have to go to physical therapy. I cannot work now and am able to collect some unemployment. Still, I cannot pay my bills and I am depressed from being stuck in pain in my apartment. I like my landlord very much and don't want to sue her for a lot of money, but am I entitled to lost wages? Two visitors have made comments about my front step being too small and dangerous, which is how I fell. I never reported this hazard to my landlord. Do I have a case? Thank you very much.

It sounds like you have a very good personal injury case and could recover damages for your pain and suffering, lost wages, and out of pocket medical expenses. Although you will have to sue your landlord, she will not be hurt since she has insurance for this very purpose.

It appears that you have a legitimate personal injury case. Also, in the event that you sue your landlord, it would not be for personal assets but,rather, for insurance.
