Legal Question in Personal Injury in New York

fender bender

I was involved in a minor fender bender with $700 of damages to the other vehicle. My ins. covered that and now, 2 years later, they are seeking personal injury comp. How much could they be compensated for this ?

The amount a plaintiff in a personal injury lawsuit can be compensated depends on the injury(ies)proved. In New York, a plaintiff has to prove more than an injury, a plaintiff must prove a "serious" injury, which is not always easy to do. Your insurance carrier should have appointed a lawyer to represent you. Your insurance carrier will pay any judgment obtained against you up to the limits of your insurance policy.

With such minimal auto damage it is difficult to imagine the injuries as too serious, but one never knows. On the one hand, the case may eventually be dismissed for want of a "serious" injury. But occasionally, even minor trauma can produce significant bodily. Inform your insurance broker or company to the receipt of any papers without delay. All you can do is see how it plays out.
