Legal Question in Personal Injury in New York
I was hit by a car while bicycling through NYC in April of 2006. There was a case and there was a settlement in spring of 2008 but I still have not received the settlement check from the lawyer who worked on the case. What can i do to pressure him into sending me the check? It is now fall of 2009, he claims the check is in his office and can be picked up but as I am currently living in Germany (I'm american) that is not an option. I've asked him to send it but he has not done so.

Something sounds peculiar. You deserve a clear explanation for the delay. It could be that the insurance carrier involved is in liquidation ( a form of bankruptcy), meaning that the New York State Department of Liquidation has taken over the claim. If this happens the delays can be huge, and that your attorney may have not yet received the settlement money. That is the question to ask: Has your attorney received the settlement funds? If so, you must get your share promptly. If you can't get answers, a complaint can be filed with the Bar Association. Best, M. E. Zuller
