There is no one-size-fits all answer. You need to satisfy the "serious injury" threshold that applies to accident involving motor vehicles. Given that you suffered head trauma, you may need to be worked up to see if you suffered a traumatic brain injury - something many lawyers miss. Be sure to file for no-fault insurance coverage within 30 days of the accident; the hospital probably already took care of this. In addition, if you have a car or live with someone who does, you should place your carrier on notice because you uninsured/under insured coverage may come into play depending on the coverage and the coverage on the car that hit you.
