Legal Question in Personal Injury in New York
My husband refused treatment in a psychiatric emergency treatment center and walked out. The psychiatrist called police and made false statements to the police which resulted in 25 police cars and the swat team surrounding our house with snipers posted on neighbors porches and rooftops to force us out of our house and have the police bring my husband back to the psych ER. The head psychiatrist interviewed him briefly and allowed him to come back home. Can I press charges against the doctor who made these false statements to the police?

If you wish to file a complaint against the doctor there are two options.
You may chose one or both. First, you can file a complaint with the New York State Office of Professional Medical Conduct. They will investigate and take action against the doctor's license if it is warranted by the facts.
The second option is to contact the District Attorney's Office and file a complaint with either them or the police department. It is rare, though, for the DA or the Police to take action in these types of circumstances.
