Legal Question in Personal Injury in New York
My husband slipped on water at the grocery store yesterday. He hit his head on a shelf and was unconscience for a minute. When he got up he was dizzy and he couldn't hear well. He also had a large lump on the back of his head. Because he has medical problems and is on blood thinners we thought it best that he be taken to a hospital by ambulence. The hospital preformed a scan on his head and everything checked out ok, except his blood pressure was extremly high. Today he is ok, but says he still has a very bad headache. The store said that a risk manager would contact us, but I would like to know if if would be best to get an attorney before talking with anyone. Please advise.

You should definatly speak with an attorney and do not speak with risk management as they are not trying to help you. In this type of case, you need to show that the store either created the water spill or had actual or constructive notice of it. These can be hard cases. A lawyer should write to risk management asap and demand they save any surveillance that showed not only the fall but when and how the water got on the floor. While it is early yet, your husband could have a traumatic brain injury. Loss of consciousness and memory problems are signs. The scan at the hospital is meaningless because they are not specific enough tests. Your husband sounds like he may have a sucessful claim against the grovery store, however, do not let the risk manager trick you out of your rights.
