Improper Burial or Removal of a deceased mother
My mother passed away and was scheduled to be held in a crypt or vault until her masoleum was paid in full. Without notice to any member of my family they moved her from her crypt and buried her in an unmarked grave after a few payments had lapsed. Is this against the law? They threw her in the ground and didn't even know where she was when I finally found out and inquired.

Re: Improper Burial or Removal of a deceased mother
Without examining the contract for the burial
which could have different provisions it
would appear that there is a breach of the
contract with a high degree of negligence.
This should be further examined by counsel.

I received your post on 6-12-2001.
Normally, there might be a cause of action, however the payment lapse complicates matters.
Please feel free to call me (845-878-2163 or 212-764-5428) to discuss this as the facts are too sparse to intelligently answer your question.
Good Luck
