Legal Question in Personal Injury in New York

Injured in a bar - over 1 year ago

At a grand opening of a bar on Dec. 16th 2005, I was picked up by someone and dropped. Resulting in 7 stitches to the top of my head, and two broken teeth (front) that had to be extracted and I now wear a partial. The bar did nothing (it happened under their roof during an open bar situation) and the person responsible left town after I offered alternatives to split the $8400 bill which I don't have. Questions are - have I waited too long and is there anything I can do about anyway?

You haven't waited too long. An action for negligence must be commenced within three years of the date of accident.

However, you have not supplied enough facts for me to determine if you have a meritorious case.

The person who dropped you is the primary culprit but it is very hard to recover money from individuals. Most people don't have sufficient assets to make a lawsuit worthwhile. If they do, those assets are fairly easy to hide.

The bar may be liable under New York's "Dram Shop Act" if the bar served alcohol to the person who dropped you despite the fact that that person was visibly intoxicated.

This is often very tough to prove, however.
