Injury from a Dog Bite

My grandson, while in my care was bitten by an unlicensed, and no shot record neighborhood dog. The dog was leashed in an unfenced yard only because it had caused injury by bite to another 8 days before. My grandson is five years old. I immediately notified my homeowners policy carrier and asked what to do. I then contacted my attorney who specializes in real estate. She feels since the dog owners have no renters insurance, we should do nothing and my eldest daughter sho works in insurance says the property owner has some liability here. Do I get a second opinion. My grandson has a scar and received 9 stitches to his face, his mother lost two days from work and he from school. Please give me some advice.I am very concerned regarding this scar and the danger because the dog is still loose in the neighborhood. I did file a complaint against the owners but dog control has done nothing.

it clearly appears that there is a case for your grandson..

The health department should have been notified by the doctor.

The property owner, if he knows of the dog, and the other bite, certainly may have some liability.

The dog's owner is definately liable for damages, especially since the dog has already bitten someone previously. You should get together all your expenses also the prognosis on the scar, plus a psychological evaluation of the child who was bitten, to determine emotional damages. Your attorney will handle these aspects of the case. As far as insurance coverage, you first get a judgment, then, if there is no insurance carrier for the dog's owner, there are various collection devices to collect your judgment, which is valid for 20 years, with interest currently of 9% on the unpaid portion of the judgment.
