Other insurance company denying

A year ago:

My insurance company says 0% liability and the other insurance company is denying liability.The commercial vehicle was curbside between 2 NO STANDING bus tops and 2 fire hydrants.''Out of the blue(not on the police report) they claim that I was on my cell phone (it was at home ) and that I ran into the vehicle(photo's show otherwise).Is the insurance company stalling because it is a multi million dollar policy(probably umbrella;commercial vehicle of a major food distributor).I have sustained injuries(must now have lumbar fusion)and the cervical issues have not been addressed.Is this the customary''cat and mouse''game that the insurance companies play? Can I file a seerate suit against the manufacturer of the ''HINO 268'' because the driver got out saying ''where did I come from?'', possibly meaning that I was in the vehicles blind spot.Possibly a suit against Toyota for selling vehicles that they knew could possibly create accidents because sufficient steps were not taken to insure that the ''blind spot''issue was taken into consideration, which contributes to many accidents?

All cars have blind spots. If the other driver asked where you came from, that's music to your ears because the driver must see what there is to be seen. If the other car has enough coverage, I would not worry about suing the manufacturer of the car because it will slow your case down and just because there is a blind spot does not mean the car is negligently designed. As for the insurance companies, yes, its a cat and mouse game. They do not want to pay. If you do not already have a lawyer, we would be happy to discuss your case.
