Insurance does faulty investigation

What happens in the event that an attorney can prove that an insurance company failed to do a proper investigation?

I think you need to be more specific in your question. If you mean that you filed a claim, and the insurance company's investigation was incomplete or inadequate and they denied your claim, then you can sue the insurance company. But there are many different considerations at play, including the fact that many insurance companies have contractual limitations periods barring lawsuits after a certain period of time which are less than those provided for by statute.

I would suggest re-posting your question and being a little more specific about the type of claim, whether it's made against your insurance carrier or somebody else's, and any provisions of the insurance policy that you feel may be relevant.
