Legal Question in Personal Injury in New York

Insurance Fraud ? part II

Insurance company denies any responsibility at all. They state in letter form: We are not responsible because your client was on a cell phone when the accident occurred. The thing about this,I breceived a copy of both the ''witness'' and drivers statements and no where does it state that I was on a cell phone(lie #1).The insurance company goes on to say that the vehicle was parked and I ran into the commercial vehicle. For them to say that the vehicle was parked, would be admitting that it was parked illegally because it was between two No Standing bus stops and two fire hydrants. For me to run into the vehicle,as tey put it,I would have to drive onto the curb( lie#2).The ''witness''states that he saw me drive into the vehicle but the point of impct was on my passenger side rear door and the commercial vehicle would have blocked his vision, since the witness(who is a wholesaler for the trucking company) store was located on the passenger side of the commercial vehicle, thus blocking his vision(lie#3).I acquired a copy of the emergency phone records and my call was the first to be made, from a stranger's cell phone,as my phone was at home.I sent this in complaint form to the NYS Ins.Dept and they gave it to Frauds Bureau.
