Legal Question in Personal Injury in New York
Jurisdiction of Small Claims Court
I had an automobile accident a month ago involving property damage only (under $1,000)when a tractor trailer struck my car on the Long Island Express (in Queens). The driver lives in Florida; the owner of the rig in New Jesey; I live in Maine.
Does the Small Claims Court (nearest to where the accident occurred) have jurisdicition? If not, what are my options? Thanks.

Where did the accident occur? You can also file a claim there.
If you would like, my office is in NJ. I would be more than happy to represent you in state. You can waive your appearance for the beginning of the case; you may need to come to testify.

Unfortunately--plum outta luck--small claims in most places is where the defendant has a presence...and NY or your state is not it.
Why not contact the other car's/trucks/rigs insurace carrier...If you have the police report---I'll get the carrier name for you if you have the insurfance code number form the report near the registration info.
