Legal Question in Personal Injury in New York

Lawsuit and Insurance

I was injured in a car accident and luckily i had a police officer behind because the person ran the light. I was on disablility for 2 years and I need surgery but I am not getting the surgery and I have to live lwith this medical condition for the rest of my life.I do have a lawyer and my policy was only for a certain amount.I see tv commercials about people getting more money, can you fight for more money that was in your policy and also if the car was repossed due to you losing your job from being disabled can you sue the person for personal property if the amount is an extensive amount?

Re: Lawsuit and Insurance

The amount of YOUR insurance, is never the maximum you can recover in a suit...

I would advise you discuss this more in depth with your current attorney.

Re: Lawsuit and Insurance

I agree with Mr. Gonzalez. Your insurance is not applicable. It is the other driver's insurance which is whatyou are seeking. Your insurance may also contain a clause which can up the total amount of coverage available for you to receive. Your lawyer should have explored this with you.

Furthermore, although the easier avenue is to take the insurance coverage, the other driver may have assets which may be available to satisfy your claim.

You should act fast to determine the resources available to you before the other driver transfers assets out of his/her name.

If you would like to discuss this matter further, please feel free to contact me.
