The customary legal fee in a contingency fee case is one-third the sum recovered, after expenses are deducted from the top. Thus, a $10,000 recovery with $1,000 in expenses would mean the client receives $6,000 and the attorney a $3,000 fee plus the return of $1,000 in expenses. There is a sliding scale applicable to medical malpractice cases, the effect of which is to net the client more money, and the lawyer a lower fee, than the standard one-third arrangement.
