Legal Question in Personal Injury in New York
legal obligation of attorney
i hired an attorney after my car accident , he didn't inform me of 2 IME one that his office even rescheduled for me.I didn't receive anything in the mail for either appointments.y medical benefits are now denied. When I spoke to my attorney he told me it's not his obligation to inform me of these IME appointments because he's not a no fault lawyer, he's a personal injure lawyer. I am furious because I have no other insurance and can't go back to my doctors. I really want to change my attorney but I want to know my rights first.

You have the right to change your attorney if you are not happy with your current lawyer. This is a very important matter and you should fully trust and feel comfortable with your attorney, who you retain to represent your interests. With respect to the no-fault denial, you can seek to arbitrate the denial in an effort to reinstate the benefits. My firm handles these types of cases and I would be happy to discuss this further with you and explain all of your options. Please feel free to contact me at your earliest convenience.

Technically he is not under an obligation to inform you of the IMEs. The no fault insurer should have sent you a notice for the rescheduled date. Speak to your doctor's office about arbitrating future bills against the no fault company.
However, he is not acting in your best interests if he failed to advise you. In my experience, all P.I. attorneys advise their clients of IME dates.
You can change attorneys anytime you like. Feel free to contact me to further discuss these issues.
