Legal Question in Personal Injury in New York

Liability at employee exercise room

Employees have been given permission by the department head to bring in their personal exercise equipment (i.e. treadmill, stationary bike, ski machine) and to set up an exercise room at work. The equipment would be available for use by any employee either directly before or directly after working hours.

Question: Is this a good idea? Can employees be liable for others using their personal equipment? Can the employer be liable for anyone injured at the workplace exercise room?

Certainly any injury at work by an employee may subject the employer to a claim for workers' compensation. This would be regardless of the 'ownership' of the equipment. Inasmuch as your are prohibited by statute from suing one's employers for such an injury, a lawsuit appears unlikely. This does not mean thatiut will not be a possibility. Any non-employee could certainly sue the employer.
