It can depend on who the parties involved are, but generally in New York, you have 3 years from the date of accident.

Assuming the accident took place in NY, 3 years from the date of the accident. However, you only have 30 days to file your no-fault insurance application; no-fault pays your medical bills and lost wages.

3 years from the date of the accident, unless you are under under a legal form of incompetency
such as too under age,mental incompetency etc.
Then you add three years to the time of majority
or until someone is appointed as guardian, etc.
