Legal Question in Personal Injury in New York

in march of 2008, my mom got hit by a car while she was crossing the street. in september of 2009, her lawyer said that he settled the case but that he was going to hold onto her money because he was now going to fight to get her medical bills paid. if they couldn't get them to pay the bills, then they would have to pay the bills out of my mom's settlement. it is now 2010 and we've been trying to get a hold of him but he's always 'out of the office'. does this seem like normal activity for this type of case or is something suspicious?

Suspicious. Medical bills, up to the policy limits, are to be paid by the no fault insurance carrier (car that hit her) separate and apart from any settlement for pain and suffering.

I think that this is suspicious. There should not be this problem in a normal motor vehicle case with the bills. Did you receive a closing statement?
