Legal Question in Personal Injury in New York

Medical Malpractice/Personal Injury

I recently had surgery at a local hospital and contracted a serious infection. Due to the recent loss of my health insurance , I have incurred several medical bills and other expenses, yet alone the pain and suffering I endured. My question is do I have a case?

It depends. No case is complete without the element of both Fault, and damages.

If you are injured slightly through the fault of the hospital, but you miss no work, have no real pain and are able to do all you could before the accident, Then no you do not have a sufficient case.

Likewise if you had terrible damages but thru no fault to the hospital there is still no case. There must be both liability and damages for the case to be viable.
