Legal Question in Personal Injury in New York
Medical Malpractice/Personal Injury
I recently had surgery at a local hospital and contracted a serious infection. Due to the recent loss of my health insurance , I have incurred several medical bills and other expenses, yet alone the pain and suffering I endured. My question is do I have a case?

Re: Medical Malpractice/Personal Injury
It depends. No case is complete without the element of both Fault, and damages.
If you are injured slightly through the fault of the hospital, but you miss no work, have no real pain and are able to do all you could before the accident, Then no you do not have a sufficient case.
Likewise if you had terrible damages but thru no fault to the hospital there is still no case. There must be both liability and damages for the case to be viable.

Additional information is needed to make a reasoned determination, such as the type of surgery, the cause of the infection, the type and extent of the infection and the resulting pain, suffering and monetary damages. Please feel free to contact me to discuss this further.
