Legal Question in Personal Injury in New York

mental harrasment

Hi, I own a two family home with two co-owners. We agreed several months ago to sell. The third owner changed his mind recently. I explained to both co-owners that I needed to sell and move out of state to assist my aging mother. One co-owner is agreeable to sell but the third has done everything to make my life stressful. He has refused to help with the maintanance of our home and removed the lawn mower so we could not use it. He has vandalized the hallway leading up to his apartment and removed a washing machine we all have used for years.

This has cased me enough stress that I am getting physical ill. I am experiencing lost of appetite, fatigue and headaches and loss of work time due to this. Because of his nonsense I am being delayed in getting to my mother who is in need of assistance.

Do I Have any legal recourse? Can I sue for mental harrassment or loss of work due to the stress that has made me sick? Thank you

You cannot sue for the "mental harrassment"

You can sue for partition to force a sale of the

house This can be time consuming and can

take up to a year or longer depending upon

the county where you live you may want

to consider moving before the sale
