Legal Question in Personal Injury in New York
My mother fell in MCdonalds
My mother fell in MCdonalds,
and she broke her arm in two places and if iam not mistaken its also dislocated. She slipped then while slipping tripped over the bottom part of a chair that holds the chair in place. wich from eyes view is far more out than any other.
My mother is also diabetic and the hospital did not want to release her becouse her blood sugger kept rising after the incident.
I would like to know if its worth the hassle of suing or not?
Ty for your time

Hi-- I received your post on 11-17-2000.
First, I hope that you mom is doing better.
Second, certainly the injuries are sufficient damages, but the liability (fault) is unclear. At this early juncture, it certainly appears that a suit is warranted.
In the event that you have any further questions, please feel free to contact me at [email protected].

Re: My mother fell in MCdonalds
Usually it is not necessary to sue in a case like this. An experienced attorney should be able to negotiate a favorable settlement from McDonald's Insurance Company without the hassle of a lawsuit. This is assuming that the facts of the case impose liability on McDonald's. If you or your mother is contacted by the insurance company, you should hold off on speaking with them until after you have spoken with an attorney. I have handled numerous cases like these and they can often be resolved quickly. Please contact me at 212-208-2470 or 917-922-0835 to discuss your mother's case. I look forward to speaking with you.
