Legal Question in Personal Injury in New York

negligence lawsuit

I fell in a store a couple of years ago and although I didn't break any bones, my back has been so out of whack I have trouble walking & can't stand without leaning. Why don't attorneys want to take cases like mine? The store was definetly negligent.

Attorneys always take cases like this with two exceptions:(1) If it has been more than three years since you fell, your case is time-barred by the three-year statute of limitations for negligence cases (assuming you were over 18 when you fell); and (2) If you never sought treatment at the time of the injury and never reported the incident to the store, then proving your case may be problematic.

As Mr. Stern suggested in his response, if the thee years have passed and you were a sane grown up, then you will not be able to sue. If the store was negligent, did their insurance policy pay any medical bills? Did you report the incident? did you take any pictures? Seek any help from a doctor? All these things are important to know if any possiblility of suit still exists. Let me know if you wish to discuss
