Generally speaking, attorneys charge 1/3 of the settlement recovery as attorney fees. Office expenses may also be deducted. In some instances an attorney may charge a sliding scale depending on how far along the litigation process is at the time a case settles. That said, an attorney is free to charge any percentage he or she wants and can make accommodations for a client depending on their relationship.
Most lawyers deduct expenses from the total settlement figure, then divide the remainder into thirds. Two-thirds of that sum is the client's share, one-third the legal fees. In medical/dental malpractice cases a sliding scale applies, more favorably to the client. Best, M. E. Zuller
