I fell in a pharmacy store. The floor was slippery with some particals from the store and i slipped and fell. Injuries substained sprang ankle, pain in my hip, right breast and face, can i sue?

I am very sorry for your terrible ordeal. You can file a lawsuit if we can show that the defect or substance on the floor was known by the owner or lessee of the store. Slip and fall cases have certain prerequisites that must be met in order to bring a successful claim. The threshold issue we must overcome is notice. Notice can be actual, i.e., the store owner was told verbally or by letter that the defect or dangerous condition exists. And there is constructive notice, i.e., the defect or dangerous condition is so obvious and existing for a significant time before the accident that the person responsible is deemed to have notice. Notice, of course, must be given before your accident occurred and the person responsible be given a reasonable amount of time to fix the defect or dangerous condition. Yes, you can sue. If the injuries are not serious, you might consider Smalls Claims court. You will have to prove the pharmacy's employees either caused, or knew about the slippery condition, or had time to know about it and clean before you fell. Best, M. E. Zuller
