Legal Question in Personal Injury in New York

Parent Liability for son's car accident

My son is 18 and owns his own car in his name. He does not live with me, but still uses my address. If he gets into an accident, can I be sued? He has his own auto insurance.

Re: Parent Liability for son's car accident

You appear to have no liability in the situation as you stated. That does not mean that you cannot be sued. If you do get sued, immediately turn the matter over to your broker or carrier.

While anyone can be sued, assuming title is in your son's name, you cannot be sued successfully. At least not on the grounds of vicarious liability.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
