Legal Question in Personal Injury in New York

A party is injured in an elevator which malfunctions. Is the lawsuit initiated by the injured party limited to that one incident, or is it admissible to include similar malfunctions in the same elevator after the incident. In fact, the elevator is still not properly maintained and can cause more serious injuries.
