Legal Question in Personal Injury in New York
Once a personal injury case is filed what is the time limit that it can continue
My wife was involved in a vehicle accident approx 9 years ago. She pled guilty to a DUI charge (Violation only). The civil case has still not been settled. How long can it continue for?

There is no set time limit however 9 years is offly long. I would check the court file to see what is going on or call the insurance company.

While technically there are time limits called standards and goals. Unfortunately, they are aspirational and rarely complied with. The time limits are imposed on the Court who in turn is charged with seeing that the matter is concluded timely. As to the specific times it depends on the complexity of the case. Generally, a typical PI case can take anywhere from 1 to 3 years.

Nine years is egriegious.
Suggest you get a second opionion by having another attorney review the situation to see what can be done to have it dismissed.
