Legal Question in Personal Injury in New York

Personal Injury Case

My son was seriously bit by a dog and we have an ongoing lawsuit. I was supposed to be at Appellate Court tomorrow Wed 2/21 and the trial date for the case was scheduled to begin on on 4/23/07. My attorney just advised me their lawyer asked for a continuous and now the appellate trial is moved to 4/25/07 two days AFTER the case was supposed to begin in court. How long can their lawyer push the court dates out? Can my lawyer decline to grant a continuous?

Re: Personal Injury Case

Your lawyer can oppose, but ulitmately the judge decides whether to grant a delay or not. It's not unusual for a trial to get 1 or 2 adjournments before being marked "final" which means it must proceed.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
