Legal Question in Personal Injury in New York
personal injury
On June 18, 2007, I fell down a flight of stairs at my workplace due to a prank by a student in the building. This said student poured baby oil on the stairs and I happened to be the first one to go down these stairs. I was taken to the hospital via an ambulance. I bruised both arms and also bruised my tail bone. I am an avid golfer and before this accident I was golfing at least four times a week. Since this accident I have golfed maybe four times. My arms and wrists still give me grief and I am very unhappy with my new lifestyle. Can I sue the boy/ the school district?

Re: personal injury
You might be able to sue and recover but many different issues come into play, including notice from a legal point of view for the school district and a possible short statute of limitations.

If you work for the school district, you likely cannot sue the school district because you are entitled to workers' compensation benefits. Some collective bargaining agreements allow employees to sue a school district. Please be aware that there is a 90 day Notice of Claim requirement during which you must serve a Notice of Claim on a school district if you are eligible to sue. As I said, if you cannot sue, you are eligible for workers' compensation. As for the student, you can sue him. However, how old is he? It is unlikely that he has any assets to recover against.
