It depends on what type of claim it is. Generally, negligence claims in New York have a 3 year statute of limitaitons (time you have to file your claim) unless they are against the city or municipality. In the latter situations it could be one year or one year and 90 days. If you are planning on suing NYC you must file a Notice of Claim within ninety days of the accident.

You have 2 and one-half years to file your lawsuit.
