my wife hit a horse in 03 and the case is about to come to go to court.our lawyer told us that there is a cap of 300,000 but our medical/and on going medical,pain and suffering/andlawyer fees and insurance company payback she will not have much of a settlement.

You have a few options: First, some lawyers will accept the policy limits without investigating whether there are assets or additional policies from which you could seek additional compensation -- a second opinion from another attorney might be warranted; Second, you could ask the attorneys to reduce their fee; Third, your attorney should be acting on your behalf to reduce the amounts of any liens/subrogation claims to maximize your compensation.
