Legal Question in Personal Injury in New York

Pit Bull Attact

This is so strange but I don't know what to do! A neighbors dogs (2) killed a dozen of my chickens (in their coop) and mauled two of my goats ( they still can't stand) I was told by the town clerk (12/2006) that I didn't need to do anything - today (1/23)I was told Mr.Hess's case was adjourned because he was retaining a lawyer - why would he need a lawyer? Where do I go from here?

Contact the dog control officer inyour town. Also, report it to the Sheriff.

It sounds as if the dog's owner has already been issued some sort of appearance ticket or notice of violation and has to appear in the Town Court. You should clarify with the clerk that this is indeed the case, but also ask if the judge signed an order of protection to ensure the dog is under control while the case is pending. If there is no order of protection, then ask the clerk who is prosecuting the case. It could be the dog control officer, code enforcement officer, town attorney. Get in touch with them to make sure they are aware of what this dog has done and that you would request they please ask the court for an order of protection.
