Legal Question in Personal Injury in New York

premises liability

Several Years ago, my mother had a slip and fall accident at the property of a large retail outlet. During the fall, she broke her neck and has had to undergo multiple surgeries to correct the problems.

She has also developed a case of alzheimer's, and has also suffered a paralyzed vocal cord. She has a lawsuit that has been going on for years. however her conditions are worsening as time goes on.

The question that i have is: Do i or my brother also have a case against this retailer? due to the fact that due to their negligence she is not the same person that she was or that she should be. if not for their negligence we would not have to deal with the alzheimer's symptoms. and the shell of her former self? We would not have to deal with the episodes of her constantly choking on her food and requiring the heimlich maneuver due to paralyzed vocal cord?
