Legal Question in Personal Injury in New York

I was pushed down a set of stairs, by a guest of other tenants who are the daughters of the landlord. I made several complaints to the landlord regarding pass and present threat from this guest and daughters. I also contacted the police department regarding this situation. I was given an order of protection for one of the daughters. Because of the order of protection the harassment and threats from the guest increased. On 9/13/2012 myself and a friend was sitting on the porch, the guest arrived, upon arrival the guest came on the porch and proceeded provoke an argument regarding the order of protection and calling the police. As I stood up the guest pushed me backwards down the front steps I landed on the bottom concrete step. I tried to stand up twice but was unable to stand after my second attempt to stand the guest ran down the stair and jump on top of me and proceeded punching me. I defended myself. The guest was restrained by people standing by. The ambulance and police was called prior to their arrival the guest and the tenant (daughter) fled the scene. I was taken to the hospital emergency room. 09/14/2012 I received a threaten text message from the landlord saying for my safety it is best for me to move by 9/31/2012 if more time is needed I have until 10/15/2012.

You do have quite a few causes of action against the landlord, property owner (if different from the landlord), the daughter(s) and guests. Retain copies of all documents, including police and hospital reports, pictures, text messages and make sure you get the names and contact information for all witnesses. I hope that you already pressed charges against each and every person that assaulted you. This will not only help you get protection for yourself but will also sure up claims you will make against these individuals. You may also use the landlord's text to you after the incident for an order of protection against him as well. There are many facts that need to be discussed with you and I would be more than happy to do so. For an absolutely FREE consultation please call me at 347-702-4133 or email me at [email protected]
