Legal Question in Personal Injury in New York

Say I rented a bobcat from a local tool rental company for a big job I am running in Chicago. One night after the job was closed down, someone on the job site that was not autorized to drive the bobcat started it with a knife and drove it into a hole. The guy that was driving the bobcat was hurt very badly with his one leg cut off. Can the injured party sue the tool rental company for his injuries?
