Legal Question in Personal Injury in New York
I was at a restaurant yesterday. at the end of our meal, the waitress brought us two to go coffees. when lifting the coffee, the lid was not secured on cup, causing the coffee to spill on me and the person next to me. spoke to management and he said they have been having problems with their lids. had to go to er and get treated for second degree burns. both coffees had the lid just placed on the cups. do i have a potential lawsuit against this restaurant for not securing the lid and causing my burns and also for knowing they have faulty lids. also, shouldnt the lid company be at fault as well, since they sell this product, but the restaurant still uses them, even though they are aware and stated they never stay on?

The restaurant has a duty to act with reasonable care. If they were aware of the dangerous condition, it may be possible to hold them liable for the damages caused. Best wishes,
