Legal Question in Personal Injury in New York

I was riding my bicycle home from work and the front tire got stuck in a hole in the sidewalk. The hole was about 4 or 5 inches wide. I didn't see the hole before I rode into it because I was busy looking ahead of me. There was no cone over the hole to warn anyone and was hard to notice, it had a small blue circle spray painted around it. I flipped over my front handlebars, scraped and cut my head, elbow, the knuckles on both hands, and have bruised and swollen knees. The cuts on my right hand are extremely deep and quite painfully had to be held open and flushed. I will not be able to return to work for a few days as I work with my hands constantly as a warehouse manager. I am wondering if I have any sort of rights to make a claim against the property owner or city? I have photographs of the hole in the sidewalk and my injuries. Thanks for your help!

I strongly suggest to consult a local attorney at once. It seems to me that you might have a good case.

Assume your accident occurred in New York City. If so, we'd need to know what type of structure exists at the accident location. Private home, two-family, commercial, apartment building? Makes all the difference in sidewalk cases. Best, M. E. Zuller
