Legal Question in Personal Injury in New York

Roof Crashing In At Work

While at work, the roof/ceiling caved in on my sister's head while workers did repair there. She had undergone major back surgery just months before and she fell out of her chair. After taking some time off, her job eventually canned her beacause they said they had to fill the position. What is she entitled to?

Re: Roof Crashing In At Work

Your sister should set up a consultation with an attorney to discuss the facts of her case. She may have a good lawsuit against a number of people/companies. The facts you give are not complete enough for me to give you a firm opinion. You can locate an attorney online, or call your county bar association for a referral to a local attorney.

Re: Roof Crashing In At Work

Depending on "who" was doing the roof/ceiling repair, your sister may have either 1) a Worker's COmpensation claim or 2)a WC claim and a direct claim against the repair company.

Re: Roof Crashing In At Work

If the incident occurred at work, this is a workplace incident entitling her to worker's compensation.

If the actions occured by non-employer workers, then for her injuries, she may sue.

For any disability, she may have short-term disability in the job.

For the termination from employment, she may or may not have redress but the facts posted are insufficient to evaluate this here.

Any questions, please feel free to contact me at either [email protected] or at 212-764-5428 or 845-878-2163.

Good Luck to her and you.
