Legal Question in Personal Injury in New York

School negligence

My 10 y.o son was play tag in gym at parks and rec program. Another child fell on top of him and his toe hit the gym floor. He was sent to nurse office nurse iced it and he continued to complain of pain. They told him he had to leave office and go back to gym why he continued to c/o pain. the gym person let him sit out once he saw the pain he was in. He was then put on the bus and went all day walking on foot. which the busdriver helped him get on off bus. I was never notified until he came home and called me at work as a result he has fractured great toe which needed to be casted to prevent further fracture to joint. Orthopdic specialist wrote a letter stating program should be responsible for medical bills but I would also like to be compensated for their negligence of making him walk on it ,which specialist also wrote could have caused further damage, also for not contacting me. What am I entitled to?

Re: School negligence

I can't tell you what you "are entitled to" but you may have a claim against the school for a failure to inform as well as a causation of further injury. I would be happy to talk to you.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
