use of a settlement check by a lawyer

Is it legal for a lawyer to use a settlement check in

an interest bearing account,holding for 30 days

-without the consent or knowledge of the clien

From your post, I can't tell exactly what happened.

Did your attorney not tell you the check had arrived? Usually settlement checks are made to attorney and client, so you should have had to sign the check.

Did the attorney deposit in an account and "borrow" money for a month? IF this is what happened, it is a BIG problem.

You'll have to be more specific about what actually happened before I can tell you if your attorney did something wrong.
