Legal Question in Personal Injury in New York
slip & fall in apt bldg
I fell down a flight of stairs in an apt. bldg. I suffered a sprained wrist and a hematoma. The floor was wet and slippery. The bldg. constanly has spills on the floors and the super doesn't clean on a regular basis. DO I have a case?

From what you have said, you do have a case. Get an attorney and sue!
Re: slip & fall in apt bldg
Possibly, but there is more information that needs to be gotten before an attorney can give you a bona fide opinion.
Re: slip & fall in apt bldg
Indeed you may...but more facts need to be obtained from you as to the SPECIFICS of the water, its source, and why it is always in this condition. Without knowing this, any advice thatI can offer is not too specific to your situation.

Re: slip & fall in apt bldg
Probably not since you will have to prove notice of the defective condition by the landlord which is something you probaly cannot do. In addition, your injury is not seerious. Your potential compensation being relatively small does not warrant the effort involved in presenting a case. Wait until you have a serious injury before suing someone.
Re: slip & fall in apt bldg
Since this is still a free country, you always have the right to sue. Most experienced Personal Injury attorneys will not wish to take your case, since liability is questionable and your injuries are nominal. The case would be a nuisance, both to you and the landlord.
Suggest you do not bring this case. When you have a more serious case - if you ever do, you will do better if you do not have a history of being litigious.
