Legal Question in Personal Injury in New York

slip & fall

I was on my way in to a dept store, along the front of there store on there sidewalk they were displaying stacks of resin chairs with a cord like thin chain running thru them to prevent theft, the cord is very long and was laying across the sidewalk 1/2 way, but it was lifted up because it coming down from the chairs, I tripped over it and hurt my foot- 3 weeks later I cannot be on it for long periods of time without pain, I reported it right after it happened so they would fix the problem, the girl just rolled her eyes at me and didnt write anything down, Ive been back there 4 times and its still the same way, Do I have a case? if so how good. and How do I find an attorney ? I know alot wont take cases unless you have debilitating injuries , Im in western NY

You are not correct in your assessment of

the injury requirement. This applies only

to automobile accidents

Slip and falls require either creation of the

condition (which you appear to allege) or

prior notice (probably not present)

But it is worth exploring.

period, go back and take as many pictures

as you can of the condition. And don't worry

about the defendant's reports or lack of reports

I hope you have sought medical advice. If you want to sue the store, you will have to hvea medical documentation of your injuries.

Take pictures of the store if it has the same display and chain.

Keep contacting attorneys until you find one which will take the case.

I received your post on 7-18-2001.

It is possible that the cord was improperly placed without thought to shoppers and passers-by.

Write to the store telling them that you were refused the ability to fill out an accident report.

Take pictures now, assuming that the cord is esentially the same as it was, i.e., in all ways similar.
