Legal Question in Personal Injury in New York

Slip and Fall on Ice

My law suit has been going on for six years it is against a woman and her brother. The woman died about 3yrs ago they said that the brother was terminally ill 5yrs ago and there was no executor for her estate so we had to get one appointed legally. My lawyers came to find out that her brother was the executor and sold off her houses and recieved the money. My lawyers put a motion in with the judge to grant a trial date right away since the law suit was frozen for a year and a half waiting for the courts to appoint someone. My question is what are the chances that the judge will grant the early trial date since we have been waiting 6yrs and the other side lied about not having an executor for her estate? and shouldn't they have to answer for lieing and holding up the case the way they did?

The more "unclean" the hands of one's opponents, the better chance one has of carring the day.

Given the facts you have alleged I think the chances are pretty good you get an early court date.

Good luck
