Legal Question in Personal Injury in New York

Slip and Fall

I slipped and fell on a piece of torn carpeting in a hair salon. Can I sue? If so, what do I have to prove?

Re: Slip and Fall

Depending upon your injuries, you may have a good claim for money damages if you can show that the salon had notice of the condition.

Please feel free to contact me to discuss.

Re: Slip and Fall

Most importantly that you have an injury. Without an injury you have no basis for a claim of damages.

Re: Slip and Fall

I received your post on 11-3-2000.

In order to have a case, you must prove that the condition (the tear) was either created by the entity that you are suing, or that it (the tear) was there long enough to have been fixed, but was not.

After that, you must have sustained damages, i.e., a injury.

In the event that you have any questions, please feel free to contact me directly at [email protected].

Good Luck
