Legal Question in Personal Injury in New York
Son with 2 stitches becase of fall
My family and I were at the New York Botanical Garden this past weekend. My three year old son tripped over a wooden border located in the ground and fell onto a wooden bench. He injured his left upper cheek, which required two stitches, nonetheless his eye is severely bruised and swollen. Is this considered negligence? Do I have a substantial case?
Thank you for your anticipated help!

First off..be happy that son yor son was not more seriously hurt.
Secondly, if the stiches leave a scar of signifigicance, there may be a case.
Lastly, why did he trip..was that because fault?...or because he was where he should not have been because of lack of parental supervision?
Good Luck

1. Insufficient information to make determination.
2. Depends on how injury heals.

To paraphrase an ex-President, I suppose that depends upon your definition of substantial.
