Legal Question in Personal Injury in New York

Student Driver

I am curious to know to what extent I am liable if I allow an international student to drive my car and she happens to get into an accident. Can I be sued by the person she hits? Can I be sued by her parents even if they give me permission to lend the student the car? She will be placed on my auto insurance with proper liabilty.

I don't see how the student's parents would have a case against you since they have given you permission to lend the student the car, but certainly an injured party could sue you for negligent entrustment.

In NYS, the owner is vicariously liable for the driver...that is, you lend me your car, you as owner probably will be sued. It is the same insurance though in your case for owner driver. The insurance goes with the car, not the driver.

A vehicle owner is vicariously liable for the negligence of any permissive user of his car.

The NYS Vehicle and Traffic Law expressly provides that the owner of the vehicle is liable for any negligent acts of the driver.
