The statute of limitations is three years. However, there may be certain circumstances under which the time to commence a lawsuit is tolled such as in infancy. Also if a death is involved and you are contemplating a wrongful death claim then the statute of limitations is only two years.

Finally, don't forget that you have a 30 day statute of limitations within which to file for No Fault benefits in NY from the date of accident.

It depends what aspect of the accident. To file for no-fault benefits is 30 days. To file a personal injury claim, generally 3 years for a PI claim involving a municipality 1 year and 90 days and this all is adjusted if the accident involves a minor.

For injuries arising out of an auto accident

three years from date of accident.

If the other driver or vehicle owner is a municipality, or governmental agency other rules may apply, requiring action within a brief time period.
