Re: subway turnstile accidents in New York

That claim fails for many reasons: first where is the negligence? She got hit by a turnstile? Why? Did someone push her from behind? Second the causation sounds extremely fishy... The bulges were probably degenerative in nature and not caused by the turnstile.lastly, the damages are extremely light. So she has bulges? so do 85 percent of americans? Those damages are insignificant. Now should she have herniations and if she is willing to undergo bk or nk surgery... Then those damages are significant.

Lastly, your friend should know that she has an extremely limited time to file her notice of claim with the MTA and the NYCTA (90 days from date of accident).

Hope this answers your questions.
